Article 1 – Definitions 

The terms below used in these general conditions of sale, both in the plural and in the singular, will have the following meaning

Customer: any adult natural person, having the capacity to contract and having the status of consumer within the meaning of the preliminary article of the Consumer Code, who orders Products on the Website for non-professional purposes according to the conditions defined below below.

General Conditions of Sale or General Conditions of Sale: These general conditions applicable between Le Domaine Skincare and the Customer, which the customer declares to accept when ordering Products, and which govern the use of the Website and the sale of Products.

Le Domaine Skincare: the company Le Domaine , a limited liability company with capital of 50 000 euros, registered in the Aix en Provence Trade and Companies Register under the unique identification number 902 293 505 00027, whose head office is located at 49 Cours Mirabeau 13100 Aix en Provence, represented by its President, Marc Perrin , intracommunity VAT number FR 79 902 293 505, which designed and operates the Website through which it offers and sells the Products to Customers.

Product: any Product offered for sale by Le Domaine on the Website, in particular cosmetic products.

Article 2 – Purpose and Application of the General Conditions of Sale

These General Conditions of Sale define the rights and obligations of Le Domaine Skincare and the Customer applicable to the sale of the Products, which the Customer accepts by ordering the Products on the Website.

Unreserved acceptance of these General Conditions of Sale consists of the Customer checking the corresponding box. These General Conditions of Sale are permanently accessible on the Website, in a computer format allowing them to be printed and/or downloaded, so that the Customer can reproduce or save them.

Le Domaine reserves the right to modify the General Conditions of Sale. The applicable General Conditions of Sale will be the conditions in force and accepted by the Customer at the time of the order.

Article 3 – Product orders on the website www. beau-domaine.com

The products offered on the Website are intended for sale to individuals only. Companies, associations and all other for-profit or non-profit organizations must contact Le Domaine at the following address: sales@ beau-domaine.com

Creation of an account: the order does not necessarily imply the creation of an account by the Customer, at any time by clicking on “Connection” and “Create an account” or at the latest when placing the order.

The Customer must complete the form with the requested information. Personal data provided by the Client will be processed in accordance with the privacy policy.

The Customer undertakes to provide accurate information. The provision of false information by the Customer, making it impossible for Le Domaine to fulfill its obligations, in particular the delivery of the Products, does not incur the liability of the latter for this fact.

The account will be accessible using the login credentials (email address and password) chosen by the customer during registration. The Customer acknowledges that his username and password are strictly personal and confidential. Therefore, he must not communicate them or share them with third parties. For security reasons, the Customer is recommended to choose a strong password that complies with applicable standards (8 characters, including upper and lower case letters, numbers and special characters). In the event of suspicion of fraudulent use of their identifiers, the Customer must immediately inform Le Domaine .

The Customer Account allows the Customer to manage their information and addresses, order history, loyalty points and manage their personal data.

Selection of Products: to place an order via the Website, the Customer must select the Products he wishes to purchase by adding them to the basket.

In accordance with articles L111-1 et seq. of the French Consumer Code, the characteristics of the Products are detailed on the pages of the Website relating to each Product.

The Customer's attention is drawn to the fact that the shopping basket is only intended to list the Products chosen by the Customer and in no way make them unavailable to other users. The Products will not be not reserved and the price updated only at the time of validation of the order.

Once the selection of Products is complete, the Customer can click on “Order” in the “Basket” tab to finalize their order.

Ordering Products: the Customer will be redirected to the basket with a summary of the selected Products and the price. The Customer will have the possibility to modify the quantities of Products or to remove a Product from the basket. In the next step, called the “Payment” step, the customer will have the possibility to consult the delivery costs and enter a promotional code. He can finalize his order by clicking on Order.

Unless he is already connected, the Customer will be able to create an account but this is not obligatory to place his order. Only an email address will be required to continue. Then, the Customer must provide their address (delivery and billing address if different). Then, the Customer will choose their delivery method from those offered and proceed to payment.

The Customer will receive a confirmation email with the details of their order.

The order will only become firm and final after payment of the price.

Le Domaine reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order.

In addition, as a member of a selective distribution network, Le Domaine sells the Products on the Website only to retail and end consumers. Consequently, it is prohibited to sell, buy, or receive as gifts the Products with the aim of reselling them outside our networks, in particular on websites. In addition, any order which clearly does not correspond to a retail sale, and more particularly if the quantities of Products ordered are abnormally high for buyers with consumer status, and more generally, any fraudulent order, may be canceled.

Availability of Products: Le Domaine undertakes to honor orders received only within the limits of available stocks.

If the Product is not available, in particular if the Product has become unavailable between the time of placing the order and receipt of payment, Le Domaine will inform the Customer within 48 working hours, indicating the deadline necessary to obtain the Product. If the order includes several Products, it can be delivered in several installments at no additional cost to the Customer. At the Customer's request, the order can be canceled for the missing Products with a refund by bank transfer.

Promotional offers: all promotional offers will only be valid if the following conditions are met simultaneously: limit of the period of validity of the offer in question and available stocks.

Automatic replenishment: This site may offer you the opportunity to subscribe to an automatic replenishment service for your purchase. Your subscription will continue until you cancel it. A recurring payment (corresponding to the amount of the product selected for automatic replenishment) will be automatically charged to your credit card each time the order is shipped. The shipping schedule will follow the frequency you requested during product selection. There is a minimum of 2 delivery cycles before you can cancel the program.

Article 4 – Price and payment of the price

Price: The price of the Products displayed on the Website is the price in force and is understood in the 22 currencies available on the site, all taxes included. In addition to the price of the Products, delivery costs may be added for each order, the amount of which is indicated in the basket and the order summary.

The sales prices of the Products are freely set by Le Domaine and may be modified at any time. The applicable price will be that of the day of the order.

In the event of a change in the VAT rate, Le Domaine will automatically apply the new rate to the order. Product prices do not include delivery costs, but they will be displayed in the basket at the time of final validation of the order.

The price is payable in cash when placing the order, by credit card or via other means of payment existing on the website such as Paypal or Klarna, via the secure area of ​​the establishment responsible for collecting the price on the page provided for this purpose.

The Customer guarantees that he is fully authorized to use the payment method he uses and that he has sufficient funds to cover the costs of the order. All bank charges related to credit card payments are the responsibility of the Customer. Under no circumstances can Le Domaine be held responsible for the fraudulent use of the Customer's bank card or bank account, except in the event of the latter's fault.

Article 5 – Delivery

Products are only sold to Customers whose delivery address is located in the countries indicated in the drop-down menu on the home page. The Products are delivered by national and international carriers.

An order can only be associated with one postal address. To send several Products to several addresses, the Customer must place a separate order for each of the addresses concerned.

Delivery is made within the indicative time indicated below (indicated in working days): 

  • Europe: 2 to 4 days 
  • America: 2 to 5 days 
  • Asia: 3 to 5 days 
  • Oceania: 3 to 5 days 

Hard to reach territories may have additional delays of up to 3 days.

In addition to this delivery time, there is a preparation time of 1 business day for the order.

The Customer can track their order at any time from the e-mail received when the order is shipped or in the event of difficulty by sending an e-mail to service@beau-domaine.com.

Any delay in delivery beyond the indicative deadline established above and not due to a case of force majeure may result in the cancellation of the sale at the initiative of the Customer by sending a registered letter with acknowledgment of receipt. In accordance with article L216-2 of the French Consumer Code, the sale will be considered canceled upon receipt by Le Domaine of the Customer's letter informing it of its decision to cancel the sale, if delivery has not been took place in the meantime. In the event of cancellation, Le Domaine will reimburse the Client for the sums paid as soon as possible and at the latest, within 14 (fourteen) days following receipt of the registered letter with acknowledgment of receipt.

In the event of return of the package by the Customer (for example incorrect address), the Customer will have to pay the associated costs (storage and/or reshipment costs).

Receipt: If the package delivered by the carrier is in poor condition and if Products are missing, the Customer is recommended to refuse the package and express reservations on the delivery note so that the guarantee offered by the carrier can be applied. The Customer must inform Le Domaine as soon as possible in writing so that Le Domaine can investigate with the carrier. The Customer's attention is drawn to the fact that receipt of the package without reservation extinguishes any action against the carrier for damage or loss if, within three days, excluding public holidays, following receipt, the damage or loss has not been were notified by registered letter.

Article 6 – Withdrawals and returns 

In accordance with the provisions of article L 221-18 of the French Consumer Code, the Customer has a period of 14 (fourteen) days to exercise their right of withdrawal and to return, at their own expense, the Products they have purchased. he ordered for whatever reasons. This period runs from the day of receipt of the Products by the Customer, the dated delivery note being taken as proof. Withdrawal can be made by sending a request to Le Domaine by email (service@beau-domaine.com) or by using the contact form on the website.

The Customer is asked to return the Products in their original, unopened packaging, accompanied by the delivery note and/or purchase order to certify that the Products were purchased via the Website and, ideally, a letter explaining the reason for refusal (optional, only for traceability reasons).

The Product(s) must be returned to Le Domaine at the following address within 14 (fourteen) days following the date on which the Customer's right of withdrawal was exercised. The costs and risks linked to the return of the Products are the responsibility of the Customer:

After receipt and verification of the Products, Le Domaine will reimburse the Customer for the amount of the Products returned within a maximum period of 14 (fourteen) days from receipt of the Products (or proof of shipment of the Products by the Customer), by the same means of payment as that used by the Customer for the purchase of the Products, unless otherwise agreed, or, at the Customer's choice, an exchange of Products or a credit corresponding to the amount of the Products returned.

In the event of depreciation of the Products resulting from manipulations other than those necessary to establish the nature and characteristics of the Products, Le Domaine may ask the Customer to pay compensation corresponding to this depreciation.

The Customer's attention is drawn to the fact that, in accordance with article L221-28 of the French Consumer Code, he cannot exercise his right of withdrawal if the Products have been unsealed after delivery and cannot be returned for reasons of hygiene and health protection.

Article 7 – Guarantees 

The products offered comply with current legislation and standards applicable in France and the Schengen area. The packaging and instructions for use are in French and English.

Given the nature of the Products, the warranty may be excluded in the event of non-conformity or hidden defect resulting from abnormal use, poor storage or modification of the Products.

In the event of a defect in the Product, the Customer undertakes to return the Product in its original packaging, with any instructions, documentation or accessories, to the following address:

If the Product defect is confirmed, shipping costs will be reimbursed to the Customer according to the rates applied by Colissimo. The Customer will be asked to provide a copy of the shipping receipt with the rate and tracking number. If the Customer does not do so, shipping costs and any reshipping costs will be the responsibility of the Customer.

In addition, the Customer undertakes to return, upon receipt of an alert e-mail, at Le Domaine 's expense, all Products that Le Domaine may ask the Customer to return (in particular in the event of withdrawal of the Product by the manufacturer, by health authorities, etc.). The Product will then be exchanged for another or an equivalent or refunded to the Customer, at the Customer's discretion.

Article 8 – Liability 

Responsibility of The Domain: The customer acknowledges and accepts that no one can guarantee the proper functioning of the network internet world as a whole.

Le Domaine has taken all reasonable precautions to ensure that all Products are correctly described. However, although Le Domaine attempts to present accurate photographs of the Products on the Website, the colors that the Customer perceives will depend on the computer used and display configurations and Le Domaine cannot therefore guarantee that the photographs correspond exactly to the Products (details, colors). Consequently, the photographs, information and visuals of the Products presented on the Website are given for informational purposes only and Le Domaine cannot be held responsible if the characteristics of the Products differ in an insubstantial manner from the visuals present on the Website.

Le Domaine cannot be held responsible in the event of failure to fulfill its obligations due to a case of force majeure, an unforeseeable or insurmountable act of a third party to the contract or attributable to the Client. The Domaine's liability can only be held for direct damage.

The hypertext links on the Website may lead to other websites whose consultation and/or use of these sites and external sources are governed by their own conditions of use and are carried out under the respective responsibility of the Client and of the publisher of said Website.

Responsibility of the Client: The IT resources (hardware, software) and communication allowing access to and use of the Website are the responsibility and responsibility of the Client.

In addition, the Client is responsible for the content he shares on the Website in the context of writing reviews. As such, it undertakes to respect the regulations in force and the rights of third parties, and to guarantee and compensate Le Domaine for direct damage resulting from a fault on its part.

Article 9 – Intellectual property 

In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, the Website and all elements, brands, designs, models, logos, graphics, photographs, texts, etc. that it contains as well as their compilation are the exclusive property of Le Domaine or of the holder of the intellectual property rights concerned, the latter not granting any license or right other than that of consulting the site.

The reproduction or use of all or part of these elements is only authorized for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. . Any other use constitutes an infringement and is punishable under intellectual property law, without prior written authorization from Le Domaine .

In addition, Le Domaine reminds the Client that any creation of a hypertext link to the home page or any other page of the Website is subject to its express, prior and written agreement.

The Client undertakes not to directly or indirectly infringe Le Domaine , the Website or the rights of Le Domaine .

Article 10 – Applicable law and disputes 

The sales contract between Le Domaine and the Customer is concluded in French and these General Conditions of Sale are subject to French law.

In the event of a dispute between Le Domaine and the Client concerning the validity, execution, non-execution or interpretation of these General Conditions of Sale or, more generally, the relationship between Le Domaine and the Client, the latter may : 

  • Send your complaint to Le Domaine , who will respond as soon as possible
  • Use mediation or any other alternative dispute resolution method.
  • Or contact one of the competent courts. In particular, the consumer may refer the matter to one of the territorially competent courts according to the Code of Civil Procedure, i.e. the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.

It is expressly recalled that requests for amicable settlement do not suspend the deadlines for taking legal action.

Article 11 – Miscellaneous provisions

If one of the non-essential clauses of these General Conditions of Sale should prove to be null or applicable under a law or regulation or following an enforceable decision of a court or a competent authority, the parties expressly agree that this contract will not be affected by the nullity of said clause.

The fact for one of the parties not to require at a given time the strict execution by the other party of any of the provisions or conditions of these General Conditions of Sale will not be considered as a definitive waiver of this provision or condition.
